Front Range Legal Services Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and JA, LLC, doing business as Front Range Legal Services (“the firm,” “we,” “us,” or “our”). They govern your use of www.frontrangelegalservices.com (the “Site”) and the accounts, online filing services, paid consultations, forms, chat, and other features we offer through it (together, the “Services”). A. Introduction

By accessing the Site, creating an account, or purchasing or using any Service, you agree to these Terms and to our Privacy Policy, which explains how we collect and use personal information and is part of these Terms. If you do not agree, do not use the Site or the Services.

If you use the Services on behalf of a company or other organization, you confirm that you have authority to bind that organization to these Terms, and “you” includes that organization.

If you become a client of the firm, your written engagement agreement governs our legal representation. If these Terms conflict with your engagement agreement, the engagement agreement controls.

B. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to create an account or purchase Services. The Site is not directed to children under 13, and we do not knowingly collect their personal information.

You may create an account with your email address or by signing in with Apple or Google. You agree to provide accurate, current, and complete information, to keep it up to date, and to keep your sign-in credentials confidential. You are responsible for activity under your account. Tell us promptly at [email protected] if you believe your account has been used without your permission.

C. No Attorney-Client Relationship

Using the Site, creating an account, submitting a form, chatting with us, booking a consultation, or emailing us does not by itself create an attorney-client relationship. You become a client of the firm only when the firm agrees in writing to represent you, typically through a signed engagement agreement or an engagement confirmation issued for a specific Service.

Before we can accept a matter, we must check for conflicts of interest. We may decline any matter for any lawful reason, including a conflict with a current or former client.

Please do not send confidential or time-sensitive information until we have confirmed in writing that we can help you. Information you share with us as a prospective client is protected as required by Colorado Rule of Professional Conduct 1.18, but sending it does not obligate us to represent you. Legal deadlines may apply to your situation, and we are not responsible for any deadline until we have agreed in writing to represent you on that matter.

D. Not Legal Advice; Attorney Advertising

The content on the Site, including practice area pages, articles, pricing examples, and fee information, is general information and attorney advertising. It is not legal advice and may not reflect the latest legal developments. Do not act or refrain from acting based on Site content without advice from a lawyer about your specific situation.

Prior results, client descriptions, and statistics do not guarantee or predict a similar outcome in any other matter. Our attorneys are licensed in the jurisdictions stated on their profiles. Some of our work, such as federal trademark, copyright, and patent matters, is governed by federal law and the rules of the relevant federal agency.

The firm responsible for the content of this Site is Front Range Legal Services, 10901 W. 120th Ave., Suite 120, Broomfield, Colorado 80021.

E. Online Services and Consultations

Scope of online services

Each online Service, such as a trademark application, provisional or design patent application, office action response, DMCA notice, or Colorado LLC formation, includes the work described on its service page and order form at the time you purchase it. Work outside that description, including follow-up agency actions, requires a separate agreement and fee.

Your responsibilities

  • Provide complete, accurate, and truthful information, and respond promptly to our questions.
  • Review drafts and filings we send you and tell us about any errors before you approve them.
  • Make sure you own or have the right to use the marks, inventions, works, and materials you ask us to file or protect.

Time-sensitive filings

Some Services must be filed by a deadline set by an agency or court, such as a response to a USPTO office action, a statement of use, or a request for an extension of time. You must submit any time-sensitive request, with complete information and payment, at least one week before its deadline. We reserve the right to refund or reject any request that is not submitted within this time frame. If we choose to accept a request submitted later, we do not guarantee that it can be completed and filed before the deadline.

No guaranteed outcome

Government agencies, courts, and other third parties make their own decisions. We cannot guarantee that a trademark will register, a patent will issue, a takedown will be honored, or an entity filing will be accepted, or how long an agency will take. Rush or expedited pricing refers to how quickly we prepare your filing, not how quickly an agency acts.

Video consultations

Paid video consultations are scheduled through our booking tools and held on Google Meet. Please join from a private location. We do not record a consultation unless we tell you first. A consultation is limited to the time purchased and does not create an ongoing attorney-client relationship unless we agree in writing to represent you.

F. Fees, Payments, and Refunds

Prices are stated in U.S. dollars and are shown on the Site or your order form when you purchase. We may change our prices at any time, but a change will not affect a Service you have already paid for.

Government and agency fees, such as USPTO, U.S. Copyright Office, and Colorado Secretary of State fees, are separate from our fees unless a service page says otherwise. They are billed at cost and set by the agency, which may change them.

Payments are processed by third-party payment processors, including Stripe and LawPay. We do not store full payment card numbers on our systems. By submitting payment, you authorize us and our processors to charge the amount shown, and you confirm that you are authorized to use the payment method.

Credit card surcharge. We may add a surcharge of up to 3% to payments made by credit card. The surcharge is never more than the processing fee we pay to accept the card. We do not add a surcharge to payments made by debit card, prepaid card, bank transfer, or check, or where the law where you are located does not allow it. When a surcharge applies, we show it before you complete your payment, and it appears as a separate line on your receipt.

Fees paid in advance are handled as required by the Colorado Rules of Professional Conduct. If a Service ends before the work is complete, we will refund any portion of the fee that has not been earned, as described in your order or engagement agreement. Government fees that have already been paid to an agency cannot be refunded by us. To reschedule or cancel a paid consultation, follow the instructions in your booking confirmation or contact us before the scheduled time.

G. Electronic Communications and Signatures

You agree that we may communicate with you electronically, including by email, through your account, and through the Site, and that these communications satisfy any legal requirement that a communication be in writing. You agree that your electronic signature or click to accept an order, engagement, or form has the same effect as a handwritten signature.

Email and chat are convenient but not perfectly secure. If you prefer a different method for sensitive information, let us know. You may opt out of marketing emails at any time using the link in the message. We will still send messages about your account, orders, and matters.

H. Your Information and Submissions

You keep ownership of the information, documents, and materials you submit through the Site (“Submissions”). You grant the firm a limited license to use, copy, and transmit your Submissions as needed to provide the Services you request, to operate the Site, and to comply with law and our professional obligations.

You are responsible for your Submissions and confirm that they are accurate and that you have the right to provide them. If you submit a DMCA notice or counter-notice through the Site, you understand that knowingly materially misrepresenting that material is infringing, or that it was removed by mistake, can make you liable for damages under 17 U.S.C. § 512(f).

I. Acceptable Use

You agree not to:

  • use the Site or Services for any unlawful, fraudulent, or deceptive purpose, or to file anything you know to be false;
  • impersonate another person or submit information about someone without authority;
  • interfere with, overload, or disrupt the Site, or attempt to gain unauthorized access to any account, system, or data;
  • upload malware or other harmful code;
  • use bots, scrapers, or other automated tools to access or copy the Site, including to collect content for training artificial intelligence or machine learning models, except for search engines indexing the Site in accordance with our robots.txt file; or
  • copy, modify, or reverse engineer the Site or its underlying code, except as the law expressly allows.

J. Intellectual Property

The Site and its content, including text, graphics, photographs, page designs, code, and the Front Range Legal Services name and logo, are owned by the firm or its licensors and protected by copyright, trademark, and other laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view and use the Site for your own informational purposes and to use the Services you purchase. You may print or save pages for your own reference if you keep all copyright and other notices. Any other use requires our prior written permission.

K. Copyright Complaints

We respect intellectual property rights. If you believe material on the Site infringes your copyright, send a notice that meets the requirements of 17 U.S.C. § 512(c)(3) to [email protected] or to the address in Section U, with “Copyright Notice” in the subject line.

L. Third-Party Services and Links

The Site uses and links to services operated by others, including Stripe and LawPay for payments, Calendly for scheduling, Google Meet for video consultations, Apple and Google for sign-in, and nGage for website chat. Your use of those services is subject to their own terms and privacy policies. We do not control and are not responsible for third-party websites or services, and a link does not mean we endorse them.

M. Disclaimers

To the fullest extent permitted by law, the Site and its general content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that its general content is complete or current.

Nothing in these Terms limits any duty the firm owes to a client under an engagement agreement or the Colorado Rules of Professional Conduct, or any right that cannot be waived under applicable law.

N. Limitation of Liability

To the fullest extent permitted by law, the firm and its owners, attorneys, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to your use of the Site or its general content. Our total liability for any claim arising from your use of the Site will not exceed the greater of the amount you paid us for the Service giving rise to the claim or one hundred U.S. dollars ($100).

This Section does not limit the firm’s professional responsibility to clients for legal services, liability that cannot be limited under applicable law, or liability for our gross negligence or willful misconduct.

O. Indemnification

You agree to indemnify and hold harmless the firm and its owners, attorneys, employees, and contractors from third-party claims, losses, and reasonable attorneys’ fees arising from your violation of these Terms, your misuse of the Site, or Submissions you knew or should have known were false or infringing. This Section does not apply to claims arising from legal services the firm provides to you as a client.

P. Suspension and Termination

We may suspend or close your account or limit your access to the Site if you violate these Terms, if required by law or our professional obligations, or to protect the Site or other users. You may close your account at any time by contacting us. Closing an account does not end a pending engagement; withdrawal from representation is governed by your engagement agreement and the Colorado Rules of Professional Conduct. Sections that by their nature should survive, including Sections F, H, J, and M through S, survive termination.

Q. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules, and by applicable U.S. federal law. You and the firm agree that the state and federal courts located in Colorado have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site, and you consent to personal jurisdiction there. Before filing a claim, please contact us so we can try to resolve the issue informally. Fee disputes with clients are governed by the client’s engagement agreement.

R. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the “Last Updated” date below and, for material changes, give notice on the Site or by email. Changes apply from the date they are posted and do not apply to Services you purchased before then. Your continued use of the Site after a change means you accept the updated Terms.

S. General Terms

These Terms, the Privacy Policy, and any order form or engagement agreement are the entire agreement between you and the firm about the Site and the Services. If any provision is found unenforceable, the rest of the Terms remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them to a successor firm, subject to our professional obligations. We are not responsible for delays caused by events beyond our reasonable control, including agency system outages. Section headings are for convenience only.

T. Accessibility

We want everyone to be able to use the Site, including people who use screen readers, keyboard navigation, screen magnification, voice control, or other assistive technology. We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA.

We work toward that goal by building pages with clear headings, labels, and page landmarks, and by checking the Site with automated accessibility tools and by hand. We are continuing to improve the Site, and some pages may not yet fully meet these guidelines. Some features are provided by third parties, such as our payment processor and sign-in providers, and we do not control their accessibility.

If you have trouble using any part of the Site, or need information in a different format, please call us at 303-459-7898 or email [email protected]. Tell us which page you were on and what happened, and we will work with you to provide the information or service another way, such as by phone or email, and to correct the problem.
