John A. Arsenault
Current practice areas include copyright and trademark law including the Digital Millennium Copyright Act (“DMCA”), cyberlaw matters, trademark registration, sending and responding to subpoenas, patent prosecution, cease and desist letters, addressing the European Union General Directive Privacy Regulation (GDPR) and California Consumer Privacy Act (CCPA) compliance, removal of infringing content hosted online, and defense of copyright infringement.
As a Colorado patent attorney, John also has responded to countless office actions for software, nanotechnology, and mechanical patent applications on both the federal and international level. John has drafted the claims and specifications for several issued and currently pending design and utility patents. For corporate clients, John has drafted End-User License Agreements, privacy policies, provided international patent strategy advice, addressed trademark infringement claims, copyright assignment questions, non-disclosure agreements, non-compete agreements, licensing valuation, and more.
John Arsenault represents clients in business, infringement, and/or licensing disputes. John’s previous background in the software industry and knowledge of open source software licenses places him in a unique position to accurately and efficiently answer intellectual property and computer law questions for clients as both an expert in technology and as an intellectual property attorney.
After working at two software companies in Austin, Texas, John began law school in 2005 at the University of Oregon School of Law in Eugene, Oregon. During law school, John served as associate editor for the Oregon International Review of Law and as an on-campus research assistant for two professors at the Knight Law School. Knowing the areas of law he wished to specialize in after law school, John focused his legal studies on intellectual property, business law, and computer law.
John enjoys both college and professional sports in addition to snowboarding, tennis, computer technology, video games, and trivia.

Intellectual property, copyright, trademark, patent preparation, cryptocurrency and blockchain, internet, privacy, business transactions, licensing, employment law, corporate subpoena responses, and regulatory compliance.
2010: John provided intellectual property legal assistance during the development of a multi-million dollar software product released in 2010, including creation of the DMCA policy, assistance with the End-User License Agreement, and the Privacy Policy.
2012: John helped broker a large transaction involving sale of a crypto currency application to a currency exchange.
2013: John helped broker a transaction for curriculum materials with a large Community College District located in the Western United States worth in excess of $500,000.00 for the owner.
2014: John helped establish that an online service provider must register their DMCA agent with the U.S. Copyright Office before the safe harbor protections of the DMCA can be invoked.
2017: Representing several defendants in a trade secrets matter, John successfully defended against a motion for a preliminary injunction against a national training program and was able to resolve the matter without substantial litigation.
2018: John successfully led the defense of an individual sued for fraud and misrepresentation who operated a large cryptocurrency exchange in several different US federal courts.
2019: Assisted a computer developer wrongfully accused of computer hacking an internet payment provider with avoiding potential federal criminal charges.
